Terms of Service

These terms are the agreement between you and Sidewndr Studios, a sole proprietorship based in Pennsylvania, United States, for the Nularo app. By downloading or using Nularo, you agree to them.

Nularo is entertainment, not healthcare. It is a companion app that displays your own fitness information and reacts to it with a personality. It is not a medical device, not a doctor, not a therapist, and not a coach. It does not diagnose, treat, or give health advice, and nothing it says should be treated as a reason to start, stop, or change anything about your health. If you are worried about your sleep, your heart, or anything else, talk to a qualified professional.

What Nularo does

Nularo reads sleep, movement, and heart information from Apple Health with your permission, displays it, and gives you one reaction each morning in the voice of a small creature that lives in the app. It also calculates a "Creature Age" from your habits, using published public health guidelines as a reference. That number is a rules-based interpretation of behavior. It is not a clinical measurement, not a biological age, and not a diagnosis.

The creature's voice

The creature is blunt on purpose. It is written to be funny and unimpressed, and it reacts to what you did rather than telling you what to do. It is a character. If you would rather it were gentler, you can change its savagery in Settings, and you can stop using it whenever you like.

AI-generated content

The creature's daily line is written by an AI model, not a person, and nobody reviews it before it reaches you. We run it through an automated check first, one that looks for the things this character must never say (advice, diagnosis, anything about body or weight) and swaps in a line we wrote ourselves if it fails, but that check is a set of rules, not a human editor. Treat every line as entertainment, written in character. It can still be wrong, oddly phrased, or miss the point of your night, the same as any other automated system can.

The model is Google's Gemini, and it only ever runs if you say yes. The first time Nularo asks to read Apple Health, it also asks, separately, whether you want your verdict written by AI. That question is off until you turn it on. If you leave it off, or switch it off later under Settings, nothing about your nights is sent to Google and the creature writes from lines we wrote by hand. Exactly what gets sent, and what does not, is listed in our Privacy Policy.

Using Nularo, including reading, hearing, or acting on anything the creature says, does not create a doctor-patient, therapist-patient, coach-client, or any other professional relationship between you and us. Nularo is not for emergencies. If you think you are having a medical or mental health emergency, call 911 or your local emergency number. If you are in crisis or thinking about harming yourself, stop using the app and contact the 988 Suicide & Crisis Lifeline (call or text 988 in the US) or your local emergency services immediately, the creature cannot help you with that and was never built to.

HIPAA does not apply here

We are not a doctor, a hospital, an insurer, or anyone working on their behalf, so we are not a "covered entity" or a "business associate" under HIPAA, and the information Nularo holds is not protected health information under that law. This is not a loophole we are relying on, our Privacy Policy and Consumer Health Data Privacy Notice describe protections we hold ourselves to regardless. It is here so nobody assumes a legal protection that does not exist. Do not use Nularo as a place to store medical records, and do not send us clinical information you need handled under HIPAA.

Your account

You can create an account with Sign in with Apple or Google. You are responsible for the account you sign in with. Do not share it. Tell us if you think someone else has access to it. You must be at least 13 years old to use Nularo.

Subscriptions and billing

Nularo offers an auto-renewing subscription. The plans and prices shown in the app at the moment of purchase are the ones that apply. At the time of writing they are:

Refunds

Apple is the seller for everything bought inside Nularo. We never see your card and we have no technical ability to issue a refund, reverse a charge, or cancel a subscription on your behalf. That is not us passing the buck, it is how the App Store works for every app on it.

To ask for a refund, go to reportaproblem.apple.com and sign in with your Apple Account, or use the "Report a Problem" link in the receipt Apple emailed you. Pick the purchase and tell Apple why. Apple usually accepts requests made within 90 days, decides each one itself, and its decision is the one that counts.

Email us anyway if something actually broke. We cannot overrule Apple, but we can write to them describing what went wrong on our side, and a request backed by the developer tends to go better than one without. We would rather do that than have you feel stuck.

If you are in the EU, the EEA, or the UK, you have a statutory right to withdraw from a purchase of digital content within 14 days. Because Apple is the seller, you exercise that right with Apple, through the same reportaproblem.apple.com page. Note that this right can end early once you start using digital content, if you agreed to that at the time of purchase, which is standard on the App Store. Nothing in these terms takes away a refund or cancellation right your local law gives you.

Outside of that, we do not offer separate refunds, part-refunds for unused time, or credit for periods you did not use the app. Cancelling stops the next charge, it does not refund the current one, and you keep access until the period you have already paid for runs out.

We may change prices or plans in future. A change never affects a period you have already paid for, and you will always see the current price before you agree to it.

Some states give you additional rights or disclosures around automatically renewing subscriptions. Nothing in this section limits those, wherever they apply to you.

What belongs to whom

The app, the creature's design, its writing, and everything else we made stay ours. You get a personal, non-transferable license to use them inside the app. What you write in the app stays yours. Screenshots and share cards produced by the app are yours to post wherever you like.

Availability

We will try to keep Nularo working, but we do not promise it will always be available or error free. Features may change. If we ever discontinue the app, we will give reasonable notice and will not charge you for a period you cannot use.

Ending it

You can stop using Nularo at any time by cancelling your subscription in your Apple Account settings and deleting the app. We may suspend or end access if these terms are seriously or repeatedly broken.

Disclaimers and liability

Nularo is provided "as is". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose. We are not liable for indirect, incidental, or consequential damages, and our total liability to you is limited to the amount you paid us in the 12 months before the claim.

Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Some places do not allow certain exclusions, so parts of this section may not apply to you.

Apple

This agreement is between you and us, not with Apple. Apple is not responsible for Nularo or its content, and has no obligation to provide support for it. Apple is a third-party beneficiary of these terms and may enforce them against you.

Changes

We may update these terms. We will change the date at the top and, if the change is material, tell you in the app. Continuing to use Nularo after a change means you accept it.

Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Pennsylvania.
